Anyone familiar with Shakespearean plays is familiar with Banquo’s ghost in the Lady Macbeth play. The CA Supreme Court seems to have similar moments. In this instance the Court granted a late petition for review based on the defendant’s death. Although how this case is of enormous public interest if the defendant is dead is a mystery. No disrespect intended to the deceased.
This case does not involve contract issues, it does not involve a deceased’s estate or any probate matter. The CA Supreme Court accepted the review petition, granted it and ordered that no further proceedings be initiated against this defendant. How further criminal proceedings can be initiated against a corpse remains a mystery.
