The denial of supplemental briefing is not a discretionary right that the Court of Appeal has as CA government code section 68081 specifies that the court SHALL afford parties the opportunity for supplemental briefing

68081.  Before the Supreme Court, a court of appeal, or the
appellate division of a superior court renders a decision in a
proceeding other than a summary denial of a petition for an
extraordinary writ, based upon an issue which was not proposed or
briefed by any party to the proceeding, the court shall afford the
parties an opportunity to present their views on the matter through

Given the fact that Ramirez and his faithful and obedient disciples McKinster and Richli are past their retirement age, CA taxpayers who after all are funding their obscene salaries for the privilege of subjected to gross human, civil and constitutional rights abuses are left with two options – either these three “pillars of society” are flirting with dementia or are malevolent, which in either case warrants their removal from the bench.
